1. Who is responsible for your data
The data controller and owner of the personal data bank is José Augusto Pinglo Ortiz, RUC 10075091392, operating under the trade name Buckler Professionals, with registered address at Calle Los Molinos de San Miguel 175, Dpto. 3, Urb. 2. Scope
This policy explains how we process the personal data we collect through this website, its forms, meeting scheduling, and the channels we use to reply to you (email and messaging).
3. What data we process
- Data you give us when you fill in a form, book a meeting or write to us: first and last name, email, phone number, company, job title, reason for contact and the content of your message.
- Business-relationship data generated while we serve you: meetings booked, emails and messages exchanged, proposals and quotes.
- Browsing data, collected by a cookie-free analytics tool: pages visited, date and time, referring page, device and browser type, and approximate country. The country is estimated from the IP address; the IP address itself is not stored in clear text, only in pseudonymized form (an irreversible hash). This data is not linked to your identity.
4. Why we use your data and on what legal basis
- To answer your request for information, a quote or a meeting, and to follow up. Basis: your consent when submitting the form and the steps prior to a contract.
- To deliver the services contracted and manage the relationship with you or your company. Basis: performance of the contract.
- To send you commercial communications (news, content, invitations), only if you gave us your express consent. You can withdraw it at any time through the link in each message or by writing to us.
- To measure and improve the website with aggregated browsing statistics. Basis: our legitimate interest in keeping a useful site; the data used cannot identify you.
- To comply with legal and tax obligations and requests from authorities.
Providing your data is voluntary. If you do not provide it, we will not be able to handle your request or contact you.
5. Who we share your data with
We do not sell, rent or transfer your personal data to third parties for their own purposes. It is processed on our behalf, under contract, by the providers we need to operate:
- Amazon Web Services: hosting of the website and of the database where contacts are stored.
- The email and calendar providers we use to reply to you and schedule meetings.
- Messaging services (for example, WhatsApp Business) when communication takes place over that channel.
We may also disclose data to public authorities when required by law.
6. International data transfers
The servers where your data is stored are located in the United States (Amazon Web Services). The providers listed in section 5 may process data from other countries where they operate. These transfers take place under contracts requiring the providers to apply security and confidentiality measures equivalent to those of Peruvian law. By sending us your data, you consent to this transfer.
7. How long we keep your data
- Contact and business-relationship data: for as long as the relationship lasts or until you withdraw your consent, and for up to five years after the last interaction to meet legal obligations and possible claims.
- Browsing data: kept in pseudonymized, aggregated form for statistical purposes.
8. Your rights
You can exercise your rights of access, rectification, erasure, objection, withdrawal of consent and data portability by writing to jpinglo@buckler.pro, stating your full name, the right you wish to exercise and a contact channel, and proving your identity. We will answer access requests within twenty (20) business days and all other requests within ten (10) business days, as provided by Peruvian Law No. 29733 and its Regulations.
If you believe we have not handled your request properly, you may file a complaint with the National Authority for Personal Data Protection (Autoridad Nacional de Protección de Datos Personales) of the Ministry of Justice and Human Rights of Peru.
9. Security
We apply technical and organizational measures to protect your data: encryption in transit (HTTPS), access restricted by user and role, and providers with recognized security certifications. No system is infallible; should an incident affecting your data occur, we will notify it as required by applicable law.
10. Minors
We do not knowingly collect data from minors. If a minor has given us data, their legal guardian may request its deletion at the email above.
11. Cookies
The use of cookies and similar technologies on this website is described in our Cookie Policy.
12. Changes to this policy
We may update this policy when our services or the law change. The current version will be published on this page with its update date.
13. Governing law
This policy is governed by Peruvian Law No. 29733, Personal Data Protection Law, and its Regulations approved by Supreme Decree No. 016-2024-JUS.
